Terms & Conditions
These Terms and Conditions ("Terms") govern your access to and use of the Sprinters mobile and web application platform ("Platform"), provided by Swift Apex Dunedin Couriers Ltd., a company registered in New Zealand ("Sprinters", "we", or "us").

By accessing or using the Platform, you confirm that:

You have read, understood, and agreed to be bound by these Terms.

You will comply with these Terms and our Community Guidelines.

You are of legal age in your jurisdiction and legally capable of entering into contracts.
If you are using the Platform on behalf of an organisation, you have the authority to bind that organisation to these Terms.
If you do not agree with these Terms, do not use the Platform.

Overview of Services
Sprinters connects users ("Users") with independent third-party delivery providers ("Drivers") for transportation, logistics, and delivery services. Sprinters does not own or operate delivery vehicles and does not directly provide logistics services.

Use of the Platform
You are granted a limited, non-transferable license to install and use the Sprinters application on compatible devices. You agree not to:

Resell, sublicense, distribute or exploit the app.

Tamper with the Platform's code, reverse engineer or probe its security.

Upload malicious content or use the Platform for harmful purposes.
Use automated scripts or bots to access the Platform.

Account Registration and Responsibilities
You must register for an account to use the Services. You agree to:

Provide accurate, up-to-date personal and contact details.

Keep your password confidential and secure.
-
Be solely responsible for activity under your account.

Not transfer your account or allow others to use it.
Sprinters may limit access based on age or jurisdiction and may suspend accounts for non-compliance.

Service Rules and Shipment Guidelines
You affirm that:

You are the owner or authorised to act on behalf of the shipment owner.

Items sent comply with all applicable laws and regulations.
-
Items are safely and adequately packaged.
You may not send:

Hazardous, illegal, or prohibited items.
-
Fragile items without proper packaging.
-
Items over NZD 500 without insurance.
Sprinters and Drivers reserve the right to reject items that are unsafe or violate these rules.

Service Level Agreements (SLAs)
SLAs vary by vehicle type. Key timeframes:

Immediate orders: Pickup within 30 minutes.

Scheduled orders: Driver arrives at set time with 10-minute grace period.
-
Pooling: Delivery within 4 hours of pickup.
Delays or failures outside of these parameters may be subject to review.

Payments and Fees
Payment can be made via cash or Card. Charges include:

Delivery fees, taxes, and platform fees.
-
Optional priority or add-on services.
-
Miscellaneous fees as quoted by Drivers.
All payments are non-refundable unless otherwise approved by Sprinters.

Promotions and Credits
Sprinters may offer promotional credits, which:

Are non-transferable and non-redeemable for cash.
-
Must be used before their expiry.
Can be revoked for fraud, misuse, or policy violation.

Claims and Refunds
Claims for damaged or lost items must be made within 24 hours of delivery. Compensation:

Is limited to the lower of the item value or delivery fee.
-
Is issued as credits.
-
Requires documented evidence and may be rejected if not sufficiently supported.

Communication and Notifications
By creating an account, you consent to receive communications from Sprinters, including service updates, promotions, and transactional information, via email, SMS, or push notifications.

Intellectual Property
All rights to the Platform, including code, and content, are owned by Sprinters or its licensors. You may not reproduce, modify, or distribute any part of the Platform without express permission.

Disclaimers
Services are provided “as is.” Sprinters does not guarantee:

Continuous or error-free service.

Quality or safety of third-party Drivers.

Timeliness or suitability of deliveries.
You assume all risks associated with using the Platform.

Limitation of Liability
Sprinters shall not be liable for:

Damages due to packaging or prohibited items.

Losses from delays or failed deliveries.
-
Indirect, incidental, or consequential damages.
Our total liability is limited to the delivery fee or value of the shipment, whichever is lower.

Indemnification
You agree to indemnify Sprinters from any claims, losses, or liabilities arising from:

Violation of these Terms.

Use or misuse of the Platform.
Disputes with Drivers or third parties.

Governing Law
These Terms are governed by and construed in accordance with the laws of New Zealand. Any dispute arising from or related to these Terms will be resolved through mediation, arbitration, or legal proceedings in New Zealand.

Modifications
We may update these Terms from time to time. Continued use of the Platform constitutes your acceptance of any changes.

Termination
Sprinters may suspend or terminate your account or access to the Platform without notice for violations of these Terms or applicable laws.

Language
In the event of any conflict between translated versions, the English version shall prevail.​
